Use of This Website
This website and its content — including but not limited to portfolio work, written copy, and downloadable resources — are provided for informational purposes. All content on this site is owned by Elijah N'Kai unless otherwise noted, and may not be reproduced, distributed, or used commercially without written permission.
Portfolio & Project Ownership Disclaimer
Certain works displayed on this site were created in a professional capacity for previous employers or clients, and remain the property of those respective companies. Please refer to the FAQs page for full details regarding ownership of specific portfolio pieces.
Project Engagements
When you engage Elijah N'Kai for a design project, the following general terms apply, unless otherwise specified in an individual project proposal or signed agreement:
Proposals & Scope
All projects begin with a defined scope of work outlined in a written proposal. Any work requested outside of this agreed scope may be considered an additional service, billed separately.
Payment Terms
A non-refundable deposit is required to begin work and reserve project timeline availability. Remaining balances are due according to the schedule outlined in your project proposal. Work will not commence, and final files will not be delivered, until associated payments have been received in full.
Revisions
Each project includes a defined number of revision rounds, as outlined in your proposal. Requests beyond the included rounds may incur additional fees.
Timelines
Project timelines are estimates based on the scope discussed and are dependent on timely feedback and material delivery from the client. Delays in client feedback may affect the final delivery date.
Cancellations
Should a project be cancelled before completion, deposits are non-refundable, as they reserve project time and cover work already underway. Any additional payments made prior to cancellation will be billed only for work completed to that point.
Intellectual Property & Final Deliverables
Full ownership of final, approved deliverables transfers to the client only upon receipt of full and final payment. Prior to final payment, all designs, concepts, and files remain the intellectual property of Elijah N'Kai. Any preliminary concepts, drafts, or design directions not selected for final use remain the property of [Elijah N'Kai / Business Name] and may be featured in future portfolio materials unless otherwise agreed upon in writing.
Confidentiality
Client information and project details shared during the course of a project will be kept confidential. A separate Non-Disclosure Agreement (NDA) is available upon request for clients requiring additional confidentiality protections.
Limitation of Liability
While every effort is made to deliver high-quality design work, Elijah N'Kai is not liable for any indirect, incidental, or consequential damages arising from the use of delivered designs, including but not limited to business outcomes, marketing performance, or third-party use of final assets.
Governing Law
These Terms of Service are governed by the laws of the United States of America, without regard to conflict of law principles.
Changes to These Terms
These Terms of Service may be updated periodically. Continued use of this website or engagement of services after changes are posted constitutes acceptance of the revised terms.
